Local Man Charged for Breaching Public Spaces Protection Order in Ilfracombe

William Flynn, aged 66, appeared at Barnstaple Magistrates Court on Friday 4 October 2024 after repeatedly breaching the Public Spaces Protection Order (PSPO) in Ilfracombe. Mr. Flynn has a history of street drinking in public areas such as Runnymede Gardens, the promenade, and most recently, Wildersmouth Beach.

Despite being aware of the PSPO restrictions, Mr. Flynn has continued to violate its terms, drawing the attention of both North Devon Council and the police. The council had previously taken action against him for breaching a Community Protection Notice (CPN), which prohibits behaviours such as causing harassment or distress to others, public intoxication and possessing open alcohol containers within the PSPO area. After a brief period of compliance, Mr. Flynn has resumed his disruptive behaviour, prompting authorities to seek stronger legal measures.

As a result, the court has granted a Criminal Behaviour Order (CBO) against Mr. Flynn. This order places stricter conditions on his behaviour, aiming to curb his ongoing street drinking and anti-social activities. The CBO is intended to serve as a more effective deterrent than previous fines and enforcement actions, addressing the significant distress his behaviour has caused to both residents and visitors of Ilfracombe.

North Devon Council Chief Executive, Ken Miles, said: “Ensuring the safety and wellbeing of our community is our top priority. We take the ongoing issues surrounding street drinking seriously and are committed to enforcing the Public Spaces Protection Order to protect our residents and visitors. Our aim is to foster a safe and welcoming environment in Ilfracombe, and we will not hesitate to take action."

The CBO will be enforced for a period of two years, with any breaches likely to result in more severe legal consequences.
